Dilapidations can be described as a 'disrepair with a legal remedy'.

Dilapidation is a term meaning falling into decay, and the word is derived from the Latin 'lapides', for scattering the stones of a building.

At mga we adopt a non-confrontational approach to dilapidation matters, starting with a thorough examination of the lease and repairing covenants, through to preparation of the Schedule of Dilapidations. Usually our involvement concludes with the successful negotiation of a financial settlement, however, we can also arrange and manage repairs and reinstatement if needed.

We have successfully acted for both Landlord and Tenant, on both Interim and Final schedules and claims.

Key Points

  • Thorough examination of the lease and repairing covenants is essential.
  • Is it a actually a Dilapidation?
  • Act in a non-confrontation manner and within prescribed timescales, to help reduce overall costs.
  • Produce clear and relevant schedules with realistic and accurate costs.
  • Negotiate Claim / Arrange Reinstatement or Formulate repair strategy.

With these matters it is advisable to obtain clear advice at an early stage, and proceed in a logical manner. If you would like to discuss any possible dilapidations issues click here to contact us.
